“Let us never negotiate out of fear, but let us never fear to negotiate”
— JFK
Mediation has been around for thousands of years and is used to solve disputes.
People interested in mediation as an alternative dispute resolution technique are particularly dissatisfied with litigation and conventional rights-based dispute procedures. As people learn more about mediation, they are using it more frequently.
What is Mediation?
Mediation is one of the Alternative Dispute Resolution (ADR) processes, in which a third party (Mediator) facilitates two or multiple parties involved into a dispute (conflict) to consider options and reach an agreement.
Mediation offers an alternative to lawsuit and trials and offers the parties involved the option of deciding the outcome and compromise they would prefer as opposed to the final, inflexible and non-negotiable court decision.
Do I have to consider Mediation?
ADR is now mandatory in all 46 counties in South Carolina for circuit and family court. Probate judges may also order mediation in cases if they think it is necessary. Some magistrate courts have mediation programs as well.
Family Mediators are available to assist with Separation, Divorces, parent-child/teen responsibility, alimony agreements and more.
Civil Mediators are available to assist with medical claims, insurance cases, business, HOA’s, neighbourhood disputes, elderly related issues, victim-offender settlements and many more.
